Cronos Med loyalty program rules, in force since August 15

 

1. ORGANISER

 

The Cronos Med Loyalty Program is organized by Clinica Medical Service S.A, located in Bacau, Str. 9 MAI, Nr. 32, Block 32, Staircase A, Floor P, Ap. 4, Bacau County, registered at the Trade Register Office under no. J04/1901/1991, unique registration code RO 985416, hereinafter referred to as the Organizer. The loyalty program includes eligible services provided by the Organizer and the affiliated companies listed in Annex 1, hereinafter referred to as Partners. The list of Partners may be unilaterally modified by the Organizer.

Services and products described in Annex 2.

Participants in the Loyalty Program are bound by the terms and conditions of the rules. The rules are available on the website www.conosmed.ro. The organizer reserves the right to modify or change these rules, and the changes will come into force after their publication on the website www.cronosmed.ro.

 

2. PROGRAMME DURATION

 

The Loyalty Program is organized and takes place on the Romanian territory in the Organizer's and Partners' workplaces. The Loyalty Programme is open-ended. The Organizer has the right to decide at any time to terminate or modify the loyalty program, without prior notice. Notice of termination of the loyalty programme will be posted by the Organiser on the website www.cronosmed.ro.

 

3. CONDITIONS OF PARTICIPATION

 

Any natural person who is 18 years of age or older at the time of applying for the Loyalty Program, following the completion of at least one purchase of goods/services at any point of business of the Organizer/Partner, can be a member of the Loyalty Program.

You can participate in the loyalty program by completing and signing the registration form at any of the Organizer's and Partners' points of work. The signed form will be handed to the Organiser/Partner employee, who will verify the data and activate the card if the form is completed correctly.

The participant is obliged to provide all the necessary data to fill in the mandatory fields of the form: name, surname, date of birth, gender, mobile phone, email address and signature.

An unsigned registration form or one with incomplete or erroneous data is not valid, which makes it impossible to participate in the loyalty program and the Cronos Med loyalty card will not be granted or will be withdrawn and the participant's membership will be cancelled.

 

4. MEMBERSHIP CARD

The membership card is the property of the Organiser.

The card can be issued in physical or digital format, at the Organizer's option, and can be used to obtain the Benefits provided for in Article 5 after a period of 24 hours from its issuance.

The membership card is not a payment instrument and does not have a payment account associated with it, its purpose being to keep track of participants and the benefits granted under the Loyalty Program, based on the digital code associated with each card.

The membership card is not nominal. However, the membership card is not transferable.

The Organizer/Partner has the right to invalidate any loyalty card after 12 months have passed since the last use or after use in violation of these rules or legal provisions.

If a loyalty card has been damaged, stolen or lost, the event must be reported to Cronos Med on 021 9097 in order to invalidate the card. The holder is entitled to a new loyalty card.

The Loyalty Program participant is responsible for the integrity of the card and compliance with the Loyalty Program participation conditions.

 

 

5. BENEFITS GRANTED

 

The valid Cronos Med Loyalty Card allows the participant to receive the following benefits during the Loyalty Program period:

  1. Direct discount of up to 10% (no more than 500 Lei) from the price of the services provided by the Organizer or the Partners, on the occasion of the first purchase after the registration in the Loyalty Program. The benefit does not apply to surgical medical services.
  2. Direct discount of up to 5% on physical products sold by the Organiser and/or Partners.
  3. Direct discount of up to 20% (no more than 1,000 lei) on the first purchase of non-invasive services made in the week of the owner's birthday.

The discount is calculated by applying the percentage to the base price of the services or products purchased in a single transaction. The basic price is the price charged by the Organiser/Partners, including VAT, without any other discounts.

The direct discount by price reduction applies to services and products provided that the final sales price (resulting from the discount granted) is higher than the purchase cost of the product, according to the legal regulations in force. If, when the discount is applied, the sales price of the services and products falls below or equalsa purchase cost, the discount will be reduced accordingly so that the final selling price of the goods and/or services is higher than the purchase cost.

The direct discount is not cumulative with any other ongoing promotion or discount on the same services or products, unless expressly decided by the Organizer.

 

6. USE OF THE CARD

 

For the use of the card and the granting of benefits, the participant must present to the Organizer/Partner's employee the card and ID card. The membership card will be scanned in order to grant the benefits available when the price of the services/products is charged. The participant undertakes to keep the card safe and not to transfer it to third parties or allow its use by third parties.

The organizer/Partner has the right to verify, based on the electronic code associated with the card, the transactions made using the card. The Organiser/Partner has the right to withhold and cancel any card used fraudulently. The Organiser/Partner shall not be liable for the impossibility of granting benefits as a result of non-compliance with the conditions of the Loyalty Programme by the Participant.

 

7. PROTECTION OF PERSONAL DATA

 

By signing the registration form, participants agree to the provisions of these rules. By signing the registration form, the participant expresses his/her express consent to the inclusion of personal data in the database of Cronos Med clinics and partners, as well as to the processing of such data for the purpose of granting benefits according to Cronos Med policy, for statistical purposes, and, if he/she has given his/her consent, for direct marketing actions, for profiling and for receiving personalized information materials from Cronos Med and partners in the loyalty program. By joining the loyalty program, the personal data of the participants will be processed for commercial communications related to the loyalty program, based on the commercial policies of the organizer.

The organizer undertakes to comply with the provisions of the European Regulation 679/2016 on the protection of personal data during the Loyalty Programme and afterwards. Thus, the organizer undertakes to maintain the confidentiality of the personal data of the participants in the Loyalty Programme and to use them in accordance with this Regulation and the legislation in force.

The organizer processes the personal data of the participants in the loyalty program in accordance with the provisions of the European Regulation 679/2016 (GDPR) on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

The provision of personal data by the participant is optional, but refusal to provide all personal data requested for the purpose of enrolment in the loyalty program leads to the impossibility of accessing the benefits of the loyalty program.

The organizer will process the name, surname, card number and purchase history in order to analyze transactions that may be fraudulent, based on the legitimate interest of the organizer.

The organizer will process your first and last name, card series, purchase history, pharmacy where the card was used, phone number, e-mail address, based on its legitimate interest to improve the quality of services offered.

The personal data of participants enrolled in the loyalty program will be processed for 12 months from the date of the last use of the Loyalty Card or until the date of withdrawal of consent, whichever occurs first. Personal data of participants enrolled in the loyalty program will be stored for 2 years from the date of the Loyalty Card invalidation or from the date of withdrawal of consent. If, after the expiry of this period, the organizer determines that it has a legitimate interest or legal obligation to further process the personal data of the participants for other purposes, the organizer will inform the participants accordingly.

In the context of processing personal data of participants enrolled in the loyalty program, they have the following rights:

Right of access to personal data processed: participants have the right to obtain confirmation as to whether or not personal data are being processed and, if so, to have access to the type of personal data and the conditions under which they are processed, by submitting a request to this effect to the organiser.

The right to request rectification or erasure of personal data: Participants have the possibility to request, by submitting a request to the organizer, the rectification of inaccurate personal data, the completion of incomplete data or the deletion of personal data if (i) the data are no longer necessary for the original purpose (and there is no new lawful purpose), (ii) the legal basis for the processing is the participant's consent and the participant withdraws his/her consent and there is no other lawful basis, (iii) the participant exercises the right to object and the organiser has no overriding legitimate grounds for continuing the processing, (iv) the data have been unlawfully processed, (v) the erasure is necessary for compliance with European or national law, or (vi) the data have been collected in connection with information society services offered to children (if applicable), where specific consent requirements apply.

Right to request restriction of processing: participants have the right to obtain restriction of processing in cases where: (i) they consider that the personal data processed are inaccurate, for a period allowing the organiser to verify the accuracy of the personal data; (ii) the processing is unlawful, but the participant does not want his/her personal data to be deleted, but the use of such data to be restricted; (iii) if the organizer no longer needs the personal data for the purposes mentioned above, but the participant needs the data to establish, exercise or defend a right of the participant in court or (iv) the participant has objected to the processing, for the period of time during which the organizer verifies whether its legitimate grounds outweigh the rights of the participant.

The right to withdraw consent to processing, when the processing is based on consent, without affecting the lawfulness of the processing activities carried out until that moment. By withdrawing consent to participate in the loyalty program, the participant will no longer be able to access the benefits granted under the Cronos Med policy and, following the withdrawal of consent, the loyalty card will be invalidated.

The right to object to the processing of data on grounds relating to the particular situation of the Participant, where the processing is based on legitimate interest, and to object at any time to the processing of data for direct marketing purposes, including profiling.

The right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning the Participant or similarly affects the Participant in a significant way.

The right to data portability, meaning the right to receive the personal data that you have provided to the organizer in a structured, commonly used and machine-readable form, and the right to transfer that data to another controller, where the processing is based on consent or performance of a contract and is carried out by automated means.

The above rights can be exercised at any time. To exercise these rights, participants may send a request via e-mail to office@cronosmed.com. In the request, the participant may indicate whether he/she wishes the information to be communicated to a specific address, which may be an e-mail address, or by a courier service that ensures that delivery will be made only in person.

Also, if the participant wishes to withdraw their consent for direct marketing purposes, they can use the "unsubscribe" option that is included in every marketing communication.

The right to lodge a complaint with the Data Protection Authority (ANSPDCP) and the right to apply to the competent courts.

All personal data processing activities described in this Regulation relate exclusively to persons who are at least 18 years old.

 

8. OFFICIAL REGULATIONS

 

The rules are available for free consultation to any Participant in the loyalty program in all Cronos Med clinics and partner locations, as well as on the website www.cronosmed.ro. By participating in this loyalty program, participants agree to abide by and comply with the terms and conditions of these rules.

  • Medical surgical services

In exceptional situations, the Organizer or Partner may unilaterally decide that certain Products/Services cannot be included in the Loyalty Program.
